Browse Forums General Discussion 1 Nov 23, 2010 12:30 pm We have been working closely with a family relative who is a licensed builder. (but is not a registered builder yet. He is going through the process of becoming registered at the moment.) He ("Builder A") has been a great help and has quoted on doing alterations to our investment property. As he's not a registered builder, and we need a registered builder for the building permit, he has engaged another builder ("Builder B" whom he knows well) to do the majority of the work. "Builder B" will take out the Builder's warranty insurance etc and is happy for his name to be on the building permit etc. In a sense "Builder A" will be project managing, while "Builder B" is doing most of the work. As all the quoting has been done by our relative "Builder A", we have agreed that we'll pay him, who will then make any neccessary payments to "Builder B" for any work he's done. The question ****** with the Builder's contract: I received this e-mail from "Builder A" yesterday: "I met with "Builder B" and discussed the need for a contract, "Builder B" is happy to continue without a contract as it would have to be between you and him and he hasn't done the quoting. A contract is really only about the payment side of things and the provision for resolving disputes about money, And he would rather leave that between us." We trust "Builder A" impeccably and I've known him all my life, however if we don't have a written contract, other than the money side of things what else do we need to be aware of? A contract is predominantly about money but there are other things there that protect both parties if things go wrong. Probably 9 times out of 10 you don't even need to look at it but I would organise one to protect everyone. Also I found this link (relevant to Victorians) that explains a lot and also includes details that if the contract is for more than $5000 it is illegal to not have one . I have since looked into the Insurance policies of Builder's Warranty Insurance & Contract Works Insurance and without a contract insurance is void. So we have requested a contract.
