Browse Forums General Discussion 1 Oct 25, 2010 3:42 am Hello Every one, I have bought a townhouse off the plan and it is already a nightmare. Not mentioning that it is still not completed after 14 months and the fact the the builder has had his licence suspended for not disclosing financial information... On the original plans under contract, there was the door from two rooms to the balcony. Believe me or not but the builder didn't actually put the door there! On top of that the balustrade is in contract as wired and he fitted the powder coated. It wouldn't be so bad if not the fact that the balcony posts are grey and the balustrade is actually black... What can I do? it could be that the house is into the settlement within next few weeks and I am not really sure should I do. thank you Re: changes to plans with no information - what to do 2Oct 25, 2010 8:11 am The plans should form part of your contract, so any changes would normally need your prior consent. Check what the contract says about alterations or substitutions first, but I'd be heading straight to a lawyer whose specialty is this type of contract law for some legal advice. You may be able to cancel the sale if the builder is found to be in breach of contract, or at the very least, get some compensation. How disappointing and frustrating for you. Re: changes to plans with no information - what to do 3Oct 25, 2010 2:00 pm This is very poor practise from the builder. You need to be contacting the state organization which handles building disputes to see where your legal standing is and what you can do about it (ie the Building Comminsion if you are Victoria). I would consider witholding the final payment until issues are resolved also although this can be problematic in itself. Good luck with what must be a really stressful situation. 0 4985 We are at the stage on our build in Kilcoy, Queensland where we need to get our fencing installed but we cant get any contact details for our neighbours to give them… 0 6165 I engaged my builder in December last year and we’ve been working on preliminary drawings for last couple of months. I got a call from the salesperson this morning… 0 567 |
