Browse Forums General Discussion 1 Sep 27, 2010 7:04 pm Hi all We're building our first home at Sydney. Now we find the neighbor built the fence on our land, almost 70cm to our side. Our side access is supposed to be above 2.5m, but now it only has about 1.8m. What should we do? Should we talk to council or directly to the neighbor? Thanks Tony Re: fence and boundary 2Sep 27, 2010 7:28 pm First of all you need to ensure your house is sited correctly, it may not be that the fence is in the wrong spot, but in fact your house. If it's a new home that you've built then it may be an idea to look back over your site plans and measure the distance between your home and the boundary fence on the other sides too. This may give a better indication as to whether your home is sited correctly. If you feel it is, then I'd be either having an independent surveyor do an assessment, or speaking with Council - or perhaps even your neighbour as they may not be aware that the fence is (potentially) in the wrong spot. Then we found, on the site plan provided by the builder, the fence is clearly on our land, but we didn't notice this before.
