Does anyone have any experiences they wouldnt mind sharing with me? I'd contact the appropriate Aboriginal Land Council for that area and ask them to get someone to check it out. Alternatively DIA (department of Indigenous Affairs) could point you in the right direction. Let me know how you go and I can make some suggestions with more detail as I work in the area. They were not near our proposed building envelope, so we didn't have to worry about it further. I'll have a look at the DA later and see whether there were any other stipulations. Have checked council info in relation to our block on line again and what it appears to be is a code CODES SEPP Sensitive - Aborig Cultural Significance Im now thinking that its more an FYI and for the builder to take that into account when cutting into the soil. Does that sound about right? I hope that doesnt delay things at all. It's already been a slow process. Currently we have our plans at Hunter Water waiting for the stamp and then onto Lake mac council. There were two. One was a 'low density artefact scatter' and the other was a 'single isolated stone artefact'. The report noted that they had 'low archaeological/scientific significance, but are important to the local aboriginal community'. Under the National Parks and Wildlife Act 1974 (NSW), it is an offence to disturb the sites [without prior approval]. Recommendations were: - The subdivision should be designed to avoid impact on the sites - If impact cannot be avoided, a 'Heritage Impact Permit' must be obtained and the local Aboriginal council may request salvage prior to disturbance - If any further relics are uncovered during subdivision activity, work must cease, and you must consult with the Dept. of Environment and Climate Change The subsequent DA approval from Council really echoed the above and really just stipulated that you need to get the appropriate approvals before disturbing anything. So to cut a long story short and back to your original question: - Echoing what bchook said, what is the nature of the cultural significance and where is it/they located? There's obviously differing categories of 'importance'. Do you or the council have a detailed report similar to what we had to do prior to subdivision? - The construction DA should specify what needs to be done My opinion is, there's certainly potential for delays if there are any artefacts on the building envelope, or any are unearthed during excavation. (but being cynical, it'd be a little hard to spot anything doing a site cut in a 20 tonne excavator!) Let us know how you go, hopefully it's something minor away from the envelope same as ours. Re: Is your land "affected by aboriginal culture significanc 7Sep 16, 2010 1:31 pm I have phoned Lake Mac Council and was advised the person with all the expertise in that area isnt in today (always the way) however someone else could help me She advised that nothing appears to have been located during the subdivision process and that it's likely to just be noted in the building approval for any excavations/building to stop if anything is located. That sounds about right to me as well. The code appears to be there because it is understood the land was lived on by aboriginal australians in the past and therefore there may be artifacts.
