However equally another builder may define it as the date they take occupation and erect fencing or place any of their construction items on the site. The actual defition of this date should be set out in your building contract usually under a clause or definition in regards to commencement, so thats the one place you can get a definate answer. I am seeking some feedback before I contact our builder as we have just received a letter stating that construction commenced on 25/8 when we believed that it had begun on 29/7 when trenches were dug for the footings before it was decided that the foundations needed piles beneath them. Our contract is a standard HIA contract. Those words are actually in bold. A little bit vague... my builder actually has that crossed out and has it defined as "when excavation works begin". I don't like your chances if it is the standard HIA contract, they don't seem to include site works as building works. I leave you to fend for yourself, figure things out yourself.
