Browse Forums General Discussion 1 Aug 21, 2010 6:41 pm hi, we are having a real serious problem with our neighbour regarding the above mentioned so i'm hoping someone can give some advice on what to do. we are in the process of building a home atm and our garage brick wall has to be on zero boundary of the existing fence. so in order to build the brick wall, we will have to tear down a portion of the fence. i have tried to approached my neighbour and asked her nicely for her consent, i've even offered to cover all costs for the fence but she still is refusing for us to remove the fence. i think the main reason she rejects this is just to make things difficult for us, as we have conflicts with them about the fence in the past. about three years ago, i bought this vacant block of land from a private sale. i've noticed that some of the fences are already constructed (that includes this particular neighbour) so i didn't think too much of it. after six months, that neighbour sent me a letter demanding the payment for my portion of the fence. i do not think that i should be paying for this fence as i bought the land after the fence was already built so the previous owner of my block should be liable for the cost. in the end, we went to mediation and settled on making $250 donation to charity (this was requested by the neighbour) in which, out of good will and hoping to resolve this quickly as we are going to be neighbours, i've agreed to do so. that was more than two years ago. anyway, back to the current issue. i understand that the council will not intervene with fencing issues between the neighbours, so i'm wondering if there is anything else we can do. i know i can't just go in and tear down the fence as that would be a wrong thing to do, so i'm hoping to hear some suggestions from this forum. going to vcat is my last resort. but if we do go down this path, what do i need to do to lodge an application? i had a look at the vcat website and seems like there is an application for directions/orders in which i can demand compensation or something. can i demand compensation from my neighbour (ie. penalties from my builder, monthly rental as i'm renting)? the most important question of all, how much chance of winning do i have? looking forward to your replies. thanks, dennis Re: Building of garage brick wall 2Aug 22, 2010 3:14 pm Hi I dont know if this helps at all, but i put up a fence at my mothers place with the then neigbour, half costs etc. About 12 months later he sold and the the new owners demolished and developed units next door. The guy came in one day and just said he was pulling the existing fence down and replacing it. He just said he would pay for it of course and that was it. So maybe you dont actually need neigbours permission if you are replacing with similiar fence and paying for it. Re: Building of garage brick wall 3Aug 24, 2010 7:07 am If they were living there when you had to go to council to get the zero lot approval, didn't they have a chance to voice their objections then, I mean, isn't there a neighbour notification period where they could have raised any objections to building there (which would mean the removal of a portion of the fence)?
