It is the law, just because you don't agree with it doesn't change it. We just don't like how they went about it all and we will not be giving them the courtesy of a reply. Cheers Lou So you mean that in the suburbs where any small spark can cause on going and on going calamity for years with neighbors. Your neighbor is fortunately released from this pressure cooker and wants some recompense for a fence that you gladly accept.I personally like this scenario. Its good business to avoid a spark in the suburbs. You're not the neighbour are you? I am sure this neighbor has less troubles than me, now Re: You have to be kidding Do I respond 49Aug 16, 2010 4:41 pm Nathan SteelFab zion187reigneth take2 We all think its a bit rude as we both talked to these people before they moved out and they never once mentioned the fence, just gutless to send a letter of demand after they moved. . If that is the case I'm going to start letterbox dropping all my old neighbours asking them for money for something they did not want, before they knew they wanted it. Am I correct? My reply negates whether he should pay or not.Do what you want its a free country. In fact because its a free country the owner can move without me judging him poorly. I believe its easier to live together without any sparks .If the guy is over the other side of the world, even better. Does the OP reply to his notice?. yes At least you have an understanding with your neighbor , which you must feel somewhat relieved that you know their position. Just try and work with a neighbor who rips all your efforts up and dismisses them without looking into a possible fix? Re: You have to be kidding Do I respond 55Aug 16, 2010 5:02 pm <Bangs head on wall again> My neighbour is totally disregarding the law, and it's pathetic that he can do that while my dog escapes my temporary enclosure and my kids can't play in their own back yard freely because he chooses to ignore the law and not pay his legally liable share of the fence for our common boundary. Yes my riddles look somewhat like lawful binding documents, where in you need to decipher them. I could have copy and pasted the quotes i was addressing a bit better though. Re: You have to be kidding Do I respond 57Aug 16, 2010 5:14 pm Nathan SteelFab YES! Hey look everyone I got him down to a one sentence answer! Well done ,i gave the same reply a few pages back. The one sentence was for you. Re: You have to be kidding Do I respond 58Aug 16, 2010 5:22 pm Zion - We did not own the block at the time the fence was constructed and there is no liablity over the land when we signed the land contract. So the neighbours have not legal avenue to clain against us for the cost of the fence. What I am angry about is the time line as I put in the orginal post the fence was constructed in Dec 2007 we purchased the land in June 2008, we first spoke to these neighbours the month we purchased the block and regularly since then until the moved about a month ago, there was never any request for payment for half the fence and they have had ample of opportunity to do so until we receive the demand over 2 years later and after they moved. I have attached a link to the qld dividing fence act as it may be different to the one in Victoria. http://www.legislation.qld.gov.au/.../D ... 030509.pdf As I said in a previous post I am not going to give them the couteousy of a reply due to the way they have handle this matter, if another letter is sent addressed to us not just the owner we may then just reply informing them that we were not the owner of the land when the fence was constructed and any claim they have would be with them. To be a good neighbour goes both ways and life is too short to go chasing after people who are so rude. Sorry about more than one line. Cheers Lou http://take2-customdesigndownslope.blogspot.com 07-10-09 omg they have cut the block 14-05-10 we finally have the keys Re: You have to be kidding Do I respond 59Aug 16, 2010 5:30 pm od <Bangs head on wall again> My neighbour is totally disregarding the law, and it's pathetic that he can do that while my dog escapes my temporary enclosure and my kids can't play in their own back yard freely because he chooses to ignore the law and not pay his legally liable share of the fence for our common boundary.
