We built a house recently in Cairns and we are loving it. When we purchase the block in the already establish suburb we were one of the last two remaining block to be built on. Our neighbours all had established boundary fences to their blocks before we purchased the land. Turn out our neighbour had installed the boundary fence 300mm inside on his side of the boundary line. The fence for us is mandatory as a part of of our building approval as we have a spa/pool and have dispendtion for no pool fence for health and access reasons approved by our local council as long as our boundary fences comply which at the moment they do. We are happy with the fences however he now wants a new one. Not becasue of the land that is on side, the land is not usable to us it is 3m above our land height and rock so we can't do anything and to be honest is a PITA as I have to act like amountain goat toget up it to spray to keep clear of weeds! He would like anew fence becasue he choose to put in a metal pool style fence and his dogs bark at our dog all the time. Our dog doesn't bark (its a freak) however it walking around doing its things sets the others off. He has stacked 6 blocks high cement blockwork bricks along the pool style fence to keep his dog from seeing our dog along the length of the fence 6 odd meters. I am worried that this weight could be detrimental to the fence that is in place and if the integrity is compromised potentially it will all come crashing down onto our garden bed or into our water tank or at worst through our sliding glass doors at the laundry! He has asked us to stop our dog from walking around that side of the fence becasue it makes his dogs bark. He has accused us of removing boundary pegs which we haven't actually ever seen there and is throwing in our faces that is illegal to do. However we havent' removed them, we are more then happy to have it resurveyed with him. We don't care about the extra land. But we don't see why we should have to pay for half of another fence becasue he doesn't like the original one he put in that is fine by us. Where do we go with this? What rights do we have and is their an advisory service I can contact. ANy thought or help would be appreciated. Thanks. And i also meant throwing i have edited it to help you understand. I have spoken with the council. They do not get involved with boundary fencing issues. However they will monitor this becasue of our boundary fence being our pool fence and it being high risk if it was removed. ANyhoo any help or suggestions would be appreciated.
