The house in question is located in Sydney NSW and has been repossessed by the mortgagee and will be auctioned. We have discovered that it has a DA approval passed in 2009 and would like to know if we can use the DA plans without the previous owner or Architect's approval / authorization. Re: Architect plans 2Aug 05, 2010 10:13 am Hi, The DA will most probably still be active. The simple answer to your question is no, you cannot use the plans without authorisation. Depending on the original contract, either the owner or the architect/designer holds the copyright to the drawings/design. use of the drawings without consent would be in breach of that copyright. Your best bet is to negotiate the release of the drawings to you from whoever legally owns them. Hope that helped. Barry.
