Easement liability?

I have recently purchased a block in a new subdivision with a drainage easement in the back part of the block. I dont have any great issue with the easement but I dont like the open concrete drain they have installed in it. It is about 50 cm wide and 20 cm deep and appears to me to be a real hazard to occupants walking around in their own yard.

I am considering asking the shire to grate the drain as a safety measure, can I use the argument its in their best interest to reduce their liability to personal injury, or as its on my property is my liability????

You should be able to encase the sewer but you will need it designed and approved and access to lot 580 to do the work

You might be able to apply to divert the sewer at your expense. In NSW you would contact a Water services co-ordinator and they would give you advice as to whether or not…
