Try it in that order. One of them usually does the trick. Re: Deviation from contract plans and specifications 3Apr 18, 2010 10:25 pm If you like the change, don't do anything .. but if you don't contact your client liaison or site supervisor and say you have noticed something has been carried out not to plan and in accordance with your contract. Legally, once all plans and contracts have been signed, the builder can only change something if a variation is raised and both of you have signed off on it. This is my understanding. Re: Deviation from contract plans and specifications 5Apr 21, 2010 8:52 am Hi AGHOME, this happened to us when they made a frame change to our main bathroom to accommodate some airconditioning pipes and didn't tell us. We found out when they sent us an amended plan in the mail. Our contract stipulates that any variations have to be agreed in writing by both parties. We wrote to them citing our contractual rights, had a discussion about alternative options, and they fixed the frame back to the original design. Have a look at your rights under the contract. If it can be rectified, you are entitled to insist that they do it. If it can't be rectified then you should be able to seek compensation. Good luck. If the variation changes the consideration you have the right to recind. Thanks for your reply! All valid points and I agree with you on many of them.
