I have a 13 acre block. Its special rural and has a building envelope 30 wide 40 m deep. The house I want to build is 29.9m wide. I am not a builder and I have never built before so I did not understand about earthworks.The builder, however should have know about earthworks and I feel that he should have informed me that there may be a problem in trying to build this house due to the earthworks falling outside of the building envelope.
I have since found out from the shire that they will not pass the plans. They apparently informed the builder in april, who up till now has never informed me.
I am meeting with the builder on thursday.
WHERE DO I STAND?
I can apply to change the shape of the building envelope which is a lengthy process with no guaranteed outcome. UNfortuneatly even if this is finally allowed due to the shape of the house etc I will only be able to get the house, septic tanks with leach drains (these are 21.5m long and cover 4m width) and 150,000l water tank (11.3m diameter) in. Due to having to leave a border of 3m around the house for earthworks. We will not be able to have a pool or workshop for my husband.
Alternatively if the builder will allow us to rotate the house around on the existing building envelope we will be able to accomodate all our requirements. We will also have to swap the entrance with the laundry room so the entrance will be at the new front position.
WHERE DO I STAND, CAN THE BUILDER DICTATE WHAT WE WILL DO.
ANY ADVICE / OPINIONS ARE TRULY APPRECIATED, I AM AT MY WITS END. THIS WAS SUPPOSE TO BE OUR DREAM WE HAVE TIED EVERYTHING UP IN THIS PROJECT.
