(We're in City of Port Phillip in Melbourne) I understand a 9m setback is required by rescode (or average of neighbours' setbacks). My neighbour on one side has built a car port, with tiled gabled roof, along our fence line and to the street. It is not joined onto their house, and overlaps the front of their house slightly. I would think setback would be based on their house not the carport but I'm not in the same council as you are. Maybe try calling the council building/planning department and see if they can offer you any guidance? At the moment my setback is 9m. I was hoping to change it to 2-3m with the carport. My neighbour three doors down has done the exact same, but their setback is now only 1m. My council (Kingston) told me no. I took in photos of neighbour's and they said they must have been approved a few yrs ago and there have been changes since and the answer was still no for me! There is another house a couple streets from me and they build a garage that begins just 1m from front boundary. I queried this with a friend who lives opposite them and they said that 5 yrs ago the people built it without council approval!!! Apparently if 7yrs lapses and council has not ordered it demolished they can keep it!! So they are just holding out and waiting. Such a big risk! I couldn't do it!! My opinion is visit the planning dep at council with a rough plan of what you want. They can bring up an aerial picture of your house and tell you whether it is likely to be approved or not. As difficult (and annoying) at times councils are you really are best to stick to their rules and regulations because it cost you alot to fight them! Good luck! Depends...
