Browse Forums General Discussion 1 Oct 23, 2007 4:59 pm Mek, can I ask how you found the process? My husband and I signed an agreement to have all works (removal and clearing) completed by xxx. As you would know, this date is dependent upon acts of god, permit processing etc.
Now, we've hit a snag and due to problems at the buyers end, the dates have moved BIG time! Now we're due to start building in December and I'm losing confidence it will be met. The only date on our signed agreement is the xxx so can I correctly assume the duration of the contract expires xxx. I see no other clauses about ending the contract and penalities etc and wondering if we should knock it on the head and just pay for demolition so it's just done. Really interested in some advice here because I'm pulling my hair out. Sorry for the vent but I'm very frustrated. They offered us the contract straight away but we did not sign until beginning of September as we were not ready to move out or start building. The contract stated they would remove the house by middle November, subject to all their standard clauses in the contract. We moved out in the last week of September, pretty much because they had a buyer ready so we were really lucky. I have no idea how they managed with all the permits etc., but I do remember trying to organise electricity/gas disconnection in a hurry.
I guess there is no guarantee that any house would get sold so consider your options, Mikita, if you have a deadline to start building. Re: House removal dramas 6Oct 24, 2007 10:16 pm Sorry I wasn't clear. We were lucky enough to sell it straight away but the people who bought it are holding up the process. They were supposed to demolish their house so ours could be pulled down and moved to their block etc by 31 Oct but haven't done it yet. Obivously this means they can't take ours yet because they have nowhere to put it! I am weighing the options and conscious if we go to demolishers now it will probably take just as long. I guess I'm just worried the date will be pushed out again and we're already cutting it fine. Anyway, thanks everyone. Re: House removal dramas 7Oct 25, 2007 12:27 pm Oh OK, I didn't quite get you Mikita. Would you be fined in any way if your house isn't off your land by due date? If not, and it's just the time that is being wasted, I would still go ahead with the removal, you will still make a profit instead of paying for demolition. The site will have to be cleared in both cases anyway. Re: House removal dramas 8Oct 26, 2007 9:35 am Mikita,
Even if your construction starts next month its gonna halt for the x mas break. On one side u shd push the buyer to speed up things and on the other side request the builder to delay few weeks. shndt be a problem. we were told by the builder to demolish ASAP but GAH wanted longer time so had no option but to demolish. Good luck. Re: House removal dramas 9Oct 29, 2007 7:52 am Sorry for the delay in my reply, our internet has been down. Thanks for the replies - we've decided to go with GAH. We spoke with the buyers over the weekend and they've assured us the house will be gone early this month. Our builders are building over Christmas, except for the main days.
