Browse Forums General Discussion 1 May 23, 2010 8:53 pm Hi I have a investment property in Melbourne which I purchased in October 2008, which is still tenanted, I plan to move there and make it as my first home. The requirement from SRO is that I have to move to the property within 11 months to claim the 1st home owners grant and now it is beyond 11 months therefore as per SRO they say I will not be able to claim the grant on this property. I want to know if there is any other way of getting the FHOG from SRO. Thanking you for any advise. Sorry to be blunt but as an investor in property you are not eligible. Re: First home owners Grant - Victoria 4May 23, 2010 9:41 pm my husband is in banking and they have had plenty of applicants miss out for this reason-if you have owned property in your name in Australia then you are classified as having been a home owner. We have married couples who cannot get the grant because one party has been in a relationaship prior where they owned property with someone else. It is irrelevant if you have owned that property to live in or as an investment-you are still a registered owner of property. We have aslo had people receive the grant, buy a unit and rent it out-but they must have it as their place of residence within that first year-as you have already indicated that you cannot meet. Contact the SRO because I've read many accounts where people who own an investment property that was never their Principle Place of Residence (PPOR) for any period and are able to get the FHOG if purchasing a new home that will be their PPOR. This probably won't work in your situation as you already own the property but you may be eligible for the FHOG if you buy another property that will be your PPOR and do not reside in your current investment. Contact the SRO for confirmation. Re: First home owners Grant - Victoria 6May 24, 2010 7:34 pm Hi jaygka, From the SRO website... * You (or at least one applicant) must occupy the home as your/their principal place of residence for a continuous period of at least 6 months, commencing within 12 months of either settlement or completion of construction (the residency requirement). The Commissioner may approve a lesser period if he is satisfied that there are good reasons why you cannot comply with the residency requirement. The Commissioner also has discretion to extend the 12 month period if satisfied that you cannot begin occupying the home within 12 months of settlement or completion of construction due to circumstances that were unforeseen or beyond your control. You should contact the SRO and provide written reasons as soon as you are aware that you may not be able to satisfy the residency requirement.
