Even if one of the other blocks we were interested in becomes available tomorrow, they are all closer to $380-$390K, and the block we've chosen is $350K, so it allows for more money on the house. I spoke with one of the sales people at Allcastle Homes (The Ponds) for more than an hour on Thursday afternoon, he said the block has really good dimensions for a corner block and also a good price, he said we would have alot of flexibility with designs etc. He also mentioned we could add more insulation to the walls and thicker glass to the windows on the side nearest Stanhope Parkway. Re: The Ponds - Land Release 265Jul 11, 2010 12:04 am Just an update, we arrived a The Ponds sales office this morning to find that some of the bigger blocks were available and my first choice (Lot 8110) 617m2 block, 18.6 frontage, 33.3 depth was available and we took it. It was $390K (which is huge) but I did want a block bigger than 600m2. My husband said as we were signing, well you've got your big block, you can build your big house and you can work for the rest of your life to pay it off. I was quick to remind him, that he could get a better paying job or take up a second job, which Michelle thought was rather funny! Can't wait to get out there tomorrow to look at display homes, knowing that we actually have a block to build on in the future. Also can't wait for April when it's registered. Min, yes, I did end up putting a deposit on a lot. My solicitor just received the contract late last week. He has highlighted for my attention some point of interest in the contract. I would like to run it by you guys who have already gone through this. 1. As soon as the contract is executed, you are assumed to be satisfied with the present state and condition of the land and can’t claim the vendor for any defects, unless those defects are arisen after the contract date. You vendor warrant to procure that water, sewerage, telephone and power services and facilities will be connected to the land, but the purchaser will bear the expense of the connection. Q: What are the possible defects for a vacant land in this situation? At what stage are the water, sewerage, phone and power services connected to the land? Can the building start soon after the registration even when these services are not connected yet or it can only happen after these services are in? I am guessing the Vendor gets the services connected to the lot but I have to pay the cost of getting the services connected up to the house, right? Roughly what are the connection costs of each of these services. I will need to include thse in the budget. 2. The completion is subject to the registration of the subdivision plan. If the subdivision plan has not been registered within 12 months of the date of the contract, either you or the Vendor is entitled to rescind the contract. Q: Are you aware of any land registratioin at The Pond that has taken much longer than the estimated registration period (published during the land sale). ie 12 months? I may have to re-consider my plans if there is a big chance this could happen. 3. The Vendor may make minor alteration in relation to lot number, size, boundary positions, measurements and dimensions of any lots shown on the draft plan. You cannot claim the vendor for minor alteration. The definition of ‘minor’ means less than 2.5% of an area. You are entitled to claim the vendor or rescind the contract if the total area of your land is reduced by 2.5% or more. Should you wish to exercise the right of rescission, you must exercise the right within 14 days receiving written notification from the vendor of the registration of the subdivision plan. Q: Is this a common clause that appears on all the land contracts at The Ponds? It is a big concern cos the purchaser could end up with a land smaller that what was advertised and yet have to pay the same price for it. Also this could affect the house plan, right? The house plan would be drawn based on the size and dimensions provided. What happens when the house plans have been submitted and approved by Council and on registration I find out the land is smaller? What happens then? If required, I would have to adjust the house plans and re-submit to Council? Have you or anyone else ended getting less than what you paid for? 4. The vendor doesn’t warrant the location of the main sewer and you can rescind the contract (ie/ cancel the contract and ask for the deposit back) if the location of sewer is substantially different to what is shown in the plan. Q: This is another concern. Looks like one can possibly a few surprises along the way. When does the sewage system normally goes in? Any one had any nasty surprise like this? I have noticed some flood warning signs when I drove around the Waterlily neighbourhood. Is this area prone to flooding? Called the Blacktown council to enquire but they could not help me cos they needed an address to be able to assist me. Obviously at this stage, I could not provide one. So I could not get any info from the Council about this. Does anyone have any information about the flooding risks at The Ponds (particularly around WaterLily area, ie near the Sales Office)? That contract is Landcoms standard one and my solicitor said they never agree to changes to it. Sewer will go in before reg it has to be signed off. Cost to set up the account are pretty low we have paid less than $300 so far. The subdivision plan is already approved as work has started already. The 12 mths thing is referred to as the sunset clause and again pretty standard. Not aware of anyone having problems with finished land the wrong size. Mine was exact to contours. As for flood the Development control plan on council website, which is called second Ponds Creek, specified all structures must be more than 10% above the 100 year flood line. The signs are more of a liability cover to stop people mucking around during storms etc as it is all designed to flow water to these places during down pour. Also alerts you to potential danger in a flash flood. Hope this info helps. Always good to hear from someone else who has just gone through the same experience. Now is the exciting part of shopping around for a new home to build than hunting for an existing one to buy. This will be a wonderful journey and experience (I hope). I am now wondering which builder I should go with to build the house - small builders or the bigger ones. I just started looking at some display homes. I know some builder offer the complete package while others offer the basics and the option to add on to the package. Genarally, I understand I could get things done separately at a better price after the house has been built, ie the floor tiles and carpets etc. Is this true? Some say smaller builders have comparatively less customers and so can concentrate on getting the job done quicker. I guess I am considering a smaller builder after I have seen the completed first floor addition to a friend's home. She is very happy with the builder - his dedication, commitment, high standards and quality of his team. I guess if I go with a smaller builder, I need to be more involved in the whole process, planning the house, getting it drawn up, shopping for the builder, etc Will it take a lot more time than just going with a bigger builder, pick a plan, make any adjustments etc? I am keen on steel frames but do not know anything about it yet. Am on a mission to find out more now. If the costs is a lot more than the wooden frames, that will immediately rule it out (unless the benefits justify the costs). Min, I started looking at your blog. I know most package builders offer a time specific build (ie 20 weeks for single level and 24 weeks for double storey). Also the popular mid size builders such as EB, Wis and Met can only have a certain amount of jobs on the go at anyone time so they don't exceed there public liability limits, therefore there is a strong (sometimes too strong?) motivation to get homes finished. There are hundreds of builders and they will all be able to work with your block, so I would say take your time and research all your options as you have time while the land waits to register.
