We would like our garage to sit on the boundary and the neighbour has a window facing the north side. We need to apply for dispensation so we can put the garage on the boundary however the distance from our fence to their house is approx 2.7. Council recommended distance is 3m plus 1m off our boundary. So i was wondering if anyone has had a similar incident and was it approved? Also what reason did you put for applying for the dispensation? i hope i've made it a lot more clearer. Re: north facing windows - Dispensation 4Mar 18, 2010 9:40 am We recently had to ask for dispensation for a high wall on the boundary. The council was Whitehorse in Eastern Melbourne. They had forced us to raise the house 600mm which also raised this garage wall on the boundary. We filled in the forms and took a copy of the plans to the neighbor who was affected. We had them sign a statement that they Did/Did Not object to the high wall. This was done on the plan. We sent all the documentation to the council and paid about $270. We received dispensation within 4 days which I thought was very good. They stamped the drawings, we sent them back to our builder who then took two weeks to get the permit finalized. The problem we have is we dont talk to our neighbour so most likely it will take longer to get a reply. I am certain that the neighbour will object so fingers grossed they approve it all.. The garage is a standard height and it appears the sun gives them plenty of light even if the garage was on the boundary..Its writing the reason why to council why we want it on the boundary is tricky. you want to put forward to council the best possible reason so they approve it all.. Re: north facing windows - Dispensation 6Mar 18, 2010 12:05 pm I think the reason the council was quick was because they had caused a lot of grief over the increase in height. I spoke to a planner at the council and he gave me all of the best ways to ensure that the application went smoothly. We got agreement from our neighbor which may not be as easy for you, however even if you don't have them agree, if you get this in writing from them it is a step that the council does not have to do and will speed up the process. I had a look at Hobsons Bay's website and their Report and Consent Application (dispensation application) had a lot less detail than Whitehorses. He ended up adding a few more notes to the drawing to ensure that it went through quickly. We have decided that we are going to visit council and get some advice on our dispensation application. I think its a great idea getting their input on the application. I'm hoping it doesnt take too long and it all gets approved.. The warning is on the sticker on the door too.
