Browse Forums General Discussion 1 Mar 04, 2010 6:58 pm Hi everyone, I spoke to the person who will be doing my building inspection. Just letting him know that I hadn't forgotten him or gone to someone else, but instead my build was taking soooooo long. So anyway, we got talking about when to notify him...before the plaster goes up. He was saying that I should email my builder and use some sort of 'legal' terms (referencing to the relevant contract clauses) to make sure that they understand that 1. I will be using an inspector (have already told them about 3 months ago, but will do it again) 2. That if they FAIL to notify me before the plaster goes up as requested, that we will be pulling down the boards, to enable him to fulfull what he's been hired for. I got the feeling that there should be some reference to our right to do this, but for the life of me I can not see anywhere within my contract where it says anything about my rights to have an inspector and my rights to be notified at the required stage, when requested. Does anyone have this reference to an inspector etc, in their contract?? Has anyone sent one of the letters to your builder??? And if you have, could I get please get a template of it? Give the topic a read. To answer your question. 19. Access to building site (1) A builder must permit the building owner (or a person authorised by the building owner) to have reasonable access to the building site and to view any part of the building works. Penalty: 20 penalty units. (2) A person who is exercising a right of access granted under sub-section (1) must not interfere with the carrying out of the building works. (3) A builder is not liable for any costs or delays— (a) that result from any failure by a person to comply with sub-section (2); and (b) that the builder notifies the building owner of in writing within 5 business days of the failure to comply occurring. this extract is taken from the domestic building contract act 1995, state legislation that explicitly grants access to sites by the owner or authorised persons. any builder who thinks they can bulldoze their way through in contravention of this, risk getting their asses kicked.
