Browse Forums General Discussion 1 Mar 01, 2010 2:45 pm Hi, I am currently during construction. The house is basically finished just waiting on a few minor items to be fixed. We had our back fence installed about 6 weeks ago, our rear neighbours had organised it with the fencer and we had no knowledge of it until we received a phone call from the fencer saying he is doing it on this date and we will need to pay him on the day. We would have like to have been consulted about it first and received quotes ect. However we let it go and got on. Now 6 weeks later they have had gravel delivered and as our house is vacant they have gained access through our property!! They removed part of the rear fence and have tacked it back up themselves. As we have the railings on our side it looks terrible!!! There is also a big crack in one of the posts. Our rear neighbour at no stage notified us that they would be removing the fence to gain access or would be accessing our property. I want our fence fixed as it is an eyesore from our side not to mention cost us $700. Can someone please give advice on what to do and how to go about it? The next step is small claims court, which costs about $120 in my state to file a suit. There is not much you can do about them using your block, all builders do it, and trust me if you had an empty block you would use it too. I know I have. Good Luck Re: Advice needed Re: Fence 3Mar 02, 2010 10:21 pm Hi Sparkle, I disagree with buildingwithhamra regarding it being ok to trespass on another property that has a nearly finished house on it and damaging a new fence. I would contact the neighbour and calmly ask them when they anticipate having the fence repaired as you will be moving in shortly. You could innocently state to them that the person who accessed your property did not contact you first and request your permission. Ask them if they have any further people that might want access to contact you prior so that you may give your consent if you deem it okay. This will just put them on alert that you are not going to put up with people trespassing and may make them think again before doing this type of thing again. It is your property and you are entitled to protect what you have worked hard for!! I disagree with the comment that it's okay because builders do it Just check and make sure that your builder or someone on your site may have given permission for access.
