Browse Forums General Discussion 1 Feb 23, 2010 2:03 pm My best friend built a unit off the plan with Premier Homes in October 2008 that was supposed to be built by August 2009. It still has not even begun yet and both the local council and Premier are giving her the run around. Excuses so far have mainly been that the plans needed to be resubmitted due to a single tree being illegally removed from the land, and Premier are awaiting council approval. Council say they are nowhere near approval since it was an illegal removal and are still fighting with Premier over this. The main problem, apart from the fact she is stuck living at her mother's and should have moved out over 6months ago, is that seh is a first hom ebuyer and has already had the extention of the $32,000 once, if the house is not built by December she loses it completely. What rights does my friend have? Is it a case of bad luck? Or is someone responsible for this mess and liable for compensation? We are trying to work out who she can go to for help when both the council and Premier seem thoroughly confused as to who is doing what when. thanks! Caz Caz & Co ALL MOVED IN!! We bought our first house off the plan, with a 10% deposit and the balance on completion, and the contract of sale definitely DID have a settlement date. We actually settled 11 days later, but there may have been provision for that ...I really can't remember now. She might be advised to get some legal advice on her rights under the contract.
