It means every house would have levy banks on the lower side! I do believe it is illegal to divert the flow of water, be it natural "overland" flow, or in particular storm water (roof water) onto your neighbours property... The problem with drainage comes when the ground is soaked, the stormwater drainage rubble pits are full, and it's still raining! Any rain then has to flow, and it'll only flow downhill! It's always wise to plan for you own blocks drainage, and then increase it to account for a failed neighbours drainage... Electrical Engineer... Don't hold that against me... And keen owner builder... Mainly the building part!! Neighbors above us had put in some drainage but not enough. Heavy rain saw our backyard flood then slowly run off into yard below us. This became such a nightmare that it contributed to us selling - neighbor below became abusive & aggressive & neighbors above must have kept changing something in their yards as it became impossible to stop the flow of water - and each time it rained the water came into our place from a different spot! Council told us it is illegal for water to flow from one place to another but we lived there for 8yrs & not a thing was done by anyone to fix the problem - so we sold & moved.
