Browse Forums General Discussion 1 Dec 02, 2009 9:11 pm Hi everyone, Just looking for some collective wisdom, i've been reviewing the estate covenants (because well i have nothing better to do on a wednesday night ).we'll be building in Sandarra after the land is titled in Feb. It currently states * Side and boundary fences must be 1.5m in height above the natural ground level of the allotment and shall finish 1.0m behind the front building line to enhance the front facade. I'm querying this as must be 1.5m seems a little strange as no front fencing is allowed, and as they finish 1m from the front building line, are only going to be visible to neighbours, why wouldn't they be what i would consider the more standard 1.8m. Which is still below the 2m max legislated in victoria as the max without needing a permit. Anywho just looking for any comments or experience from others in new estates around Melbourne in relation to this, as to whether you've chosen an estate with a fixed fence height and any attached experiences. We have covenants regarding fences, and ours must be 1.8m high, which is pretty standard for most areas. Even a short@rse like me could see over a 1.5m fence. You'd have no privacy whatsoever.... I'd query it with the developer. Re: Estate Covenants - Specified Fence Heights 3Dec 03, 2009 1:59 pm I thought our covenant was fussy, we have to 1.8meter high side & rear which must finish 1meter behind the front corner of the house made of treated and finished timber paling no colourbond allowed. 1.8 meter return at the front is only allowed if the fence is less than 2m otherwise a maxium hieght or 1.2m applies. If you want a front fence you need DAP approval, Thank god I don't have a golf course block there is even more rules..... Who comes up with all these rules... Fence could only be solid for 50% of the length of the block. After that it had to be 50% see through. Fence could not come past front line of the house.. if it did it could only be 1m high or something ridiculous. no colorbond allowed on side return fencing either. Drove us mad trying to work it all out and find something not ugly that would fit the estate requirements. She's going to follow it up with the DAP to see if we need approval for a larger height or whether they will clarify the height. We're actually not fussed with it needing to be timber, not a fan of colourbond fencing myself and even less a fan of the hardiflex my sister's new fence is required to be made in over in WA. Side Fencing The detail of all fencing is to be included on your plans when submitted to the Design Assessment Panel. • Side and boundary fences must be 1.5m in height above the natural ground level of the allotment and shall finish 1.0m behind the front building line to enhance the front facade. • Fences between lots must be constructed of timber and exposed posts. All perimeter fencing must be completed prior to occupation of the dwelling. • The owner is solely responsible for the provision of maintenance and replacement of fencing between an allotment and any adjoining screening reserve or recreation reserve. • If an allotment already has a fence or wall being part of a fence or wall erected by the Developer, the owner must not remove damage or disfigure it and must maintain it in good condition. Any alteration of part of the wall or fence shall not be made without the Developer’s written permission. 13. Front Fencing Front fencing shall not be permitted on the front boundary or anywhere within the front yard. An alternative method of defining the edge of your property is the use of hedges, which should be in order of 1.2m in height on maturity. However the one covenant that really caused us the most grief was: The front setback is to be a minimum of 4.5 metres and maximum of 5 metres from the front boundary. When the front of our block is around 12m wide and the rear is 26wide and between 4.5->5m into the block its only about 13.5m wide, it rules out A LOT of current house designs as whilst we've been able to place the garage against one boundary we still required the council minimum setback from the opposite fence. What will be more interesting is seeing how our neighbors at the end of the court with the 8m frontage do, seeing as the garage must be set back from the front of the house. I predict a sudden sprouting of cheap nasty treated pine (ugh!) fence extenders as soon as the developers move on. I used to think a few covenants would be a good thing to protect everyone's quality of life and investment, but I'm finding it quite astounding the sorts of things developers are inflicting on homebuyers. The maximum height allowed apparently is 1.8m so thats what i'll be having in our DAP submission. No comment was made as to the accuracy of the covenant. In regards to [JADED]'s comments above, pretty much our understanding is as apparently aside from us having to provide a cert of occupancy once its complete, we are to provide them an inspection to ensure compliance with the covenant. Ie that fences are built, roof colours match, its somewhat close to what was submitted. As to how and when and whats involved with that, i'm sure the intrepids who have just begun building in the titled stages will hit it first and let us all know how it goes (hopefully).
