We called him over a month ago as we found his details on http://www. website.com.au/ We spoke to him about getting some clean fill out to our address. Initially we were going to level it ourselves. He said it would cost $40 per truckload (initial red flag here when a lot of places do it for free when they need to get rid of it) We said we'd need about 3 and the first truckload came, however they couldn't get it at the back of the property as the truck was sinking in our dirt. He said he'd leave the dirt there and see if he could come back out and level it and then bring the other loads of dirt and do the same. We asked him how much to level the 3 loads of dirt and he said $200 to level all 3. He came with a bobcat and leveled the first load and said he'd be back to do the rest. My DP gave him the $200 cash then and there (silly silly mistake, however I was not there when this happened) After months of calling him asking when he was coming back (he always said it'd be this week and used MANY excuses like his wife was pregnant, he was away on business, he didn't have any dirt, ect. He even said to me at one stage.. but it will only take less then an hour to do..??) I called him again today and his whole attitude changed. Straight away instead of another excuse he said "I think there has been a misunderstanding, to come back out and level the other loads will cost you more. The $200 was just for that first load of dirt to be levelled, everything else would cost more" UMMMM NO!!!! You said $200 for the whole job, for 3 loads of dirt to be levelled. Then he had the nerve to tell me his job with me is done and HUNG UP ON ME. WHAT THE #*&@(*#&. He is just trying to get out of finishing the job he started. He never said anything about more money the last month we have been calling him and even after he mentioned more money, he didn't even ask if we wanted him to come back??? Umm.. so if anyone wants to even think of doing business with this guy. DONT. He is *******, has no work ethics and thinks he can just walk all over you and take your money. I know there isn't anything we can do as we didn't get anything in writing, we gave him cash up front and he is a bloody "not very nice person". I'm just so annoyed because I would have handled things much differently if I was organising this, but this was DP's one job I gave him. ARRRRRRRRGH. Not happy AT ALL. If not dob him into the ATO. I agree My advice for others to stop thing slike this would be: 1. Don't pay (cash or any other method) until the job has been finished. There are plenty of people out there who ask for cash upfront and then don't even start the job (or do a poor job and say it will cost more to fix etc) 2. Get a written quote if possible 3. Always get a receipt and check their ABN on the web 4. Maybe note down some more details about them if they look real ******* (like rego etc so they can be found if they give you bogus info) 5. Always get a certificate of compliance for electrical work done (i think its also needed for plumbing etc) - insurance doesn't cover you if something goes wrong and you don't have one It really annoys me when people doing cash jobs do ***! I don't mind paying cash to people I know but I hate it when the real ******* people don't declare it - then they don't pay tax like the rest of us (and in my aunties case - doesn't get child support for my 2 cousins bc her ex says he doesn't earn enough (he gets cash jobs so there are hardly any wages declared) & they live off his new wife's wages - which can't be touched to pay his child support). In your case, it's probably not worth taking him to VCAT but you could contact Consumer Affairs to see if they can help? I am going through this process with the ******* removalist company that we used, but I am suing them for over $1600 worth of damages. We had a similar experience with the company we used to demolish our old house. They were fine before the job was done, calling all the time, bending over backwards to help and making all kinds of promises. But after the job was done (and after they'd damaged neighbouring properties) they have failed to return phone calls, failed to respond to letters, and failed to turn up to an on-site meeting about the whole mess. Sure I paid them but at that point neither neighbour had *told* me about the damage. To top all of that off, they even stole our Council garbage bin ... WHO THE **** STEALS A BIN?????? Just an update: I sent a text along these lines "Hi. if I don't recieve a reply to this message today, i will phone you until I can get through to you. I have spoken to MANY other excavators and the hourly fee is average of $65 an hour (Obviously some will do a minimum of 2-3hours) You have done less then an hours work for us, not THREE like we agreed upon. You have implied for over a month you would be returning to finish the job with no mention of any additional cost. I would like a cheque for $143 as this is how much you were overpaid. We gave you $240, however you did one third of the job and we paid you an extra $10 for the load of dirt you delivered. You can make the cheque out to **, Thanks" I recieved a telephone call advising I am wasting my time and if I think that's what people charge I'm wrong and that he could give me a list of numerous places that charge $80 an hour with 5 hours minimum. I explained I'd already called a few places and gotten MUCH cheaper quotes per hour with a 2-3 hour minimum. He told me I could take him to court but I wouldn't win, I informed him I did not want to take him to court, i just want some of my money back. I then told him I'd keep calling until I got some of it back. His reply was "Keep ***ing calling then you stupid fat ugly *****, i'll just hand up everytime" and he hung up on me. Unfortunately for me.. it's already been ONE OF THOSE DAYS, so of course I get a bit teary and txt DP about it all. I then recieve a txt from Peter "I am sorry for calling you a name it was nothing personal" and then I get another txt back from DP saying he called Peter, went off at him, Peter had told DP to tell me he was sorry, but DP said that's not good enough, told him he was very unprofessional and then hung up on him. Which explains the txt from him. I then had a big teary and had to leave work for a few minutes to calm down. Why do I bother? I should have just left it. I can't beleive I thought this creep might do the right thing by us. I'm an idiot. It's only money.. i think my own self worth is more important then that.. so I'm just going to leave it. It's not just about the money, when we get ripped off its that whole feeling of being taken for a fool and the feeling of betrayal that someone wouldn't do what they said they would. As customers we trust that the people we ask for services will do what we want and it comes as a bit of a shock when you do get ripped off.
