At my friend's recent pre start appointment, the CLO handed her a letter the builder had received from the council, the letter read: Dear xyz homes The drawing for the driveway crossover we received from you for this dwelling is incorrect, please redesign and then resubmit to us for approval. The prestart lady handed her the letter and said ' we received this letter. YOU need to sort this out. You need to send them revised crossover details' Huh?!! My friend is getting the builder to do the driveway crossover as part of the build. It has nothing to do with her - Hence why the council addressed the letter to the builder. When she rang the council, the bloke she spoke to laughed himself silly when she told him what the CLO said. After a few phonecalls and emails to the builder, they are (grudgingly) going to sort it out. Unbelievable. Repositioning or redesigning a crossover is between the owner of the adjoining property and the council(and/or developer). If the builder agreed to do it they did so as a favour to your friend. If the council makes it difficult I'm not surprised they washed their hands of it. Asking the developer/council to reposition or alter a crossover is pretty common and doesn't usually involve the builder. Family members of mine have done it on several occasions. No expertise required. Tell them what you want and they design it, it'll cost you of course. Gravity. Its the law. Not sure where you are Trepidman, but in WA it's quite common practice for a builder to do driveway crossovers as part of the build. And seeing as my friend is paying the builder to do it, if there are any problems I think it's reasonable to expect the builder to sort them out. btherl & frosty, my friend is just wondering what else they'll want her to do, I'll tell her to take a bricklaying couse just in case! If you have to go to Council and say get a Planning Permit, it is usually the owners responsibility. But if it is a Building Permit (usually requiring a building surveyor but may be exempt for a crossover) its typically the Builders responsibility unless otherwise agreed. But yeah the builder should atleast redesign the crossover on the plans for the owner to submit to Council. Doesn't change the fact that they are doing it on behalf of the owner. Just like builders submit plans to council on behalf of the owner. They can and have shrugged the responsibility if it becomes an issue. It does sound like the builder is being a bit prissy. One rejection and they make it the owners problem is disappointing.
