Rather than selling the lots directly to the left of ours, they are selling them all as house and land packages (about 25 - 30 lots). They have started building the majority of houses down the other end with a few scattered up our end. So if their argument was legally valid, then they could tell me that they weren't sure what they were doing with the land until we died. My point is, the land isn't on the market (and hasn't been for well over a year now) and was allocated by the developer as a house and land package which they would build a house on and then sell. Since it's being sold as a house and land package, they are liable for fencing costs. Makes sense? chuth77 Wrong...The typical covenant reads The seller need not contribute to the cost of building any dividing fence between the Land and any adjoining land owned by it. The buyer waives any right to claim contribution from the Seller You can try and take them to the smalls claims court, but will get laughed out, and told to open your wallet on the way and pay costs!
