Browse Forums General Discussion 1 Jul 07, 2009 4:31 pm Our house is nearly finished and have started chasing the neighbours regarding fencing... all is well with 2 out of 3 as I am dealing with the people who own the land but one side is owned by a major Builder and I am getting the run around by them. This is just rank! I have called them and they look up their land and once they the person I am talking to sees they have not onsold the land they just put me on hold then come back and say I putting you though to someone to look after you......... this ends up being a meassage bank. I have left my details twice and emailed them and have yet to receive a call back So what are my options here? Can I just send a "notice to fence notice" addressed to the company and hope this will prompt a responce? I am sure they are delaying till one of their customers buy a H&L package for that block so they dont have to deal with it or that I wear the full cost. I think I will have to send the notice to fence notice as required by the fencing act, this gives them 4 weeks to reply and then I can just get the fencer to invoice them.... I guess I should have been onto this earlier as I will move in just over 2 weeks time. We've just found ourselves in a similar situation with our neighbours-to-be. Their house hasn't started construction yet, so they've decided that as fences aren't a priority for them, they don't want to pay! How RUDE!!! And not a great way to start out really is it? Any advice? I'll have to look up the fencing act, but what's this notice to fence???? Re: Builder fence run around 7Jul 09, 2009 2:35 pm here is an example of a "notice to fence" notice http://www.ballarat.vic.gov.au/library/scripts/objectifyMedia.aspx?file=pdf/7/29.PDF&str_title=Notice%20To%20Fence.PDF and here some doco on fences that may be helpful for you in queensland http://www.qls.com.au/content/lwp/wcm/resources/file/eb46d24cdef6774/dividing-fences-03may00.pdf Cheers Cozmo ______________________________ Building a PD Heywood 29 http://fromevetoeternity.blogspot.com/ Re: Builder fence run around 8Jul 09, 2009 5:47 pm Thanks Cozmo I looked up the Act which pretty much explained everything. I'm still in a bit of disbelief that someone wouldn't allocate any budget for fencing! What nerve. I think we'll serve them with a notice to fence if they don't respond to my latest email. Failing that, maybe we might just leave that fence and wait for them to move in. By then we may have no money left in our budget to pay for our share. That would be a pity wouldn't it. 2 can play that game. Sorry for the thread hijack Re: Builder fence run around 9Jul 10, 2009 3:52 pm buggers! One of my neighbours paid for their share although they weren't building anytime soon ....10 years later they still haven't started! JellyLegs What's a 'notice to fence'????
