Browse Forums General Discussion 1 Apr 27, 2009 8:01 pm Help.......Can anyone suggest where to go from here?? Our neighbours have begun construction today on a Garage in their back yard, plans went to Council etc., etc., we did not object because we were lead to believe it was just "a shed" trouble is, it is taking part of the sea view (all for me cos I am a Short A.....) away from our back verandah. I have no objection to them having a shed in the back yard - but the roof that they have is pitched! Who do we go to to stop construction? Re: Neighbours Garage Construction 2Apr 27, 2009 8:16 pm Unless it's not being constructed to the approved drawings, you should have paid more attention to the application... Contact the council and get hold of the drawings.... Talk to them and ask them what you can do... Electrical Engineer... Don't hold that against me... And keen owner builder... Mainly the building part!! Re: Neighbours Garage Construction 3Apr 28, 2009 8:58 pm Thanx Chuth77 I know that we should have paid more attention to the application, but we took our neighbours at their word (a mistake that we will not make again!)- he advised that the shed (a garage) would be 2.4 mt in height - in fact after speaking with Council (they are sending a copy of the plans) their application was for 3.2 mt (we are sure that it is a bit more than that) which included a pitched roof - not sure what will or can happen from here - but has left us feeling sick to the stomach Re: Neighbours Garage Construction 4Apr 28, 2009 9:03 pm If your neighbour told you one height and applied for another height then you can at least try to complain to the council. You may not get anywhere but it can't hurt to speak to council and explain that you were deceived, and that this is going to adversely affect your view. If they are building even higher than the planned height then you can definitely get it looked at by council. Is there any way that you can reason with the neighbour? I assume you would not want to take them to court over this. Re: Neighbours Garage Construction 5Apr 28, 2009 9:33 pm Would prefer not to have to go to court..... but feel that this will have an effect on the value of our property in the future, so this maybe what we have to do - they do have plans to extend the existing verandah, which have not yet gone to Council (we are prepared for this and will fight all the way to ensure that our view will not be completely gone) We have not yet spoken to the neighbour - I think that they are aware of the issue and are avoiding any contact - they advised when the footings were laid that the 'Concreter' had a reputation for being heavy handed with the concrete and were "worried" about the height of the footings and in turn whether this would affect our view??? Re: Neighbours Garage Construction 6Apr 28, 2009 9:59 pm would the council issue a demolition order for a few inches over approved height? or issue a fine? ’’Quondo Omni Flunkus Mortati ’’ If the women don't find you handsome, they should at least find you handy. If it's detected during build they'll try to get the build changed. If it's detected post-build they could go either way with a fine and/or demolition order. Re: Neighbours Garage Construction 8Apr 28, 2009 10:46 pm But surely at the end of the day if it is constructed as per plans approved by Council there is no recourse? Unfortunately I would think that in that case you had your chance to raise any issues - yes they may have said something to you different - but I have learnt unless it is in writing it doesn't count. Good luck with the plans from Council. Some things are worth waiting for. Unfortunately (in this case) that's pretty much the sum of it But the neighbour is being short sighted if they think that this behaviour won't come back to bite them when they apply for their next house modification - so they might want to be reasonable now if they're spoken to Re: Neighbours Garage Construction 10Apr 29, 2009 9:25 pm Thanks for the information - can't see this Council issuing a demolition order could possibly get a fine! That to us is neither hear nor there, one thing for sure - we will be looking at ALL neighbouring development applications closely in the future.
