Can anyone suggest a law firm in Melbourne who can have a look over our builders contracts? The people who did our land don't do it anymore. Thanks! Most conveyencers are now lawyers though. I dont have any recommendations though. Can anyone suggest a law firm in Melbourne who can have a look over our builders contracts? The people who did our land don't do it anymore. Thanks! I used Keelins Lawyers for conveyancing on my block of land because they were highly recommended by my Buyer's Advocate, JPP, who I would highly recommend. Very happy with the service and attention to detail and I would use them again. http://www.keelins.com.au/ Brian Re: Suggestions for solicitors advice melbourne 4Mar 31, 2009 3:58 pm Is the builder using the standard plain text HIA contract? If so, there isn't much point as they wont change anything in it 'A bottle of wine contains more philosophy than all the books in the world.' It largely looks like the standard HIA, but I'm of the school that you never sign a contract without legal advise, so I guess I would just feel safer knowing I haven't missed something that lets them sell my house or something Built with Bentley homes in Doreen All moved in Dec 2009 Now for the garden! He was recommended to us and Im glad now that he was. Hope this helps, Cheers Re: Suggestions for solicitors advice melbourne 7Apr 03, 2009 8:01 am Quote: Is the builder using the standard plain text HIA contract? If so, there isn't much point as they wont change anything in it Basically you can change any contract, the trick is to get the other party to agree to sign it as well. If you dont like the HIA contract, you can get your lawyer to recommend another contract, but like I said, the other party needs to agree to sign. You are not obligated by law to sign an HIA contract, however, the building companies ensure that you have invested significant time in your dealings with them that you wouldnt pull out just because of a "small contract issue". This is why I keep saying on this forum that the first thing you do when you approach a building company is get them to agree to an alternative contract (IN WRITING) before you agree on a house plan. That way walking out is easy (and they know it) They will always use the "go ahead, walk out, see if i care" attitude, if you have spent months making house decisions with them. Once again, a reminder...get the liquidated damages right, otherwise they will only give you $15 a week. Re: Suggestions for solicitors advice melbourne 8Apr 03, 2009 1:11 pm Can someone tell me the process from here??? We now have conditional approval from our bank for our build loan. Do we let the builder know that now or do we wait for unconditional approval before we tell him then expect the contracts after that? Any advice most appreciated - Im getting confused Lee Re: Suggestions for solicitors advice melbourne 9Apr 03, 2009 1:55 pm perhaps call the Law institute of victoria. They will have a list of solys who will meet with you (and specialise in property law) and the first session is free. Only after that session, providing you are happy with their fees etc, do you have to pay from then on. You could probably get someone close to your home too... A thankful person is a happy person. Lostris was looking for a law firm to check out contracts. If someone used a non lawyer, conveyancer to take care of legal matters they would have a lot less come back if things went wrong as well as maybe not getting sound advice in the first place. Re: Suggestions for solicitors advice melbourne 12Apr 07, 2009 4:23 am Not sure if they are full lawyers. I just did a search on google for "building contracts lawyers" and while most were for commercial property, here is one that looks like they advise on standard HIA etc. contracts... http://www.rigbycooke.com.au/areas_of_practice/building/03.php After 2 false starts, a year living overseas, two more world trips and 3 years of uncertainty we are now starting the build process again - hopefully for real this time! Keen to hear from people in the area who have got KDRB done on whom they got the build from? Looking for recommendations.
