17 months from which stages? ie. from deposit to lockup, or? Whatever the stages the timeframe is measured, 17 months is an awfully long time. They do about one job a week if we are lucky. Would not reccommend them because not only are they slow - we have lots of problems: balconies leaking, slab was built too small ands so one om my expensive columns is hanging mostly on fresh air. water is pooling where they have done some tiling. This week has started as badly as all other weeks - no work was done today. Tell me who I can complain to? Not only is Cavalier being slow - they havent fixed problems either - even though they were told to by the engineer. I retired 2 months ago - my dream home has turned into a total nightmare and Cavalier management don't care. I was hoping that I could have a happy retirement - i have instead had nothing but worry. Our builder has been painfully slow too. We signed our contract in Feb 08 and we are at fixing stage.
If you are past the contract specified completion date maybe a letter from your lawyer might be in order (?) Sorry, I am of no use at all. Thanks for your support - I am currently getting a solicitor to look at it. Also, I contacted the BSA and they said that I should put a complaint in to them and they will look at it. Is there a reason they are going so slow? Lots of other jobs on the books, lack of workers? Or are they just generally slow and unmotivated? I reckon you need to zap them straight out with your lawyer or a mediation tribunial as mentioned by others. Looks like no-one in the company wants to hear your complaints, so maybe you need to get a bit more aggressive with them. Plus they are getting very bad publicity here. I am now witholding money from them and I have got solicitor involved- keep watching and hope for the best. We signed our contract 13 months ago and we still havent reached practical completion. Our site Supervisor has been the most unreliable, untrustworthy person I have ever met! We are lucky enough to live just around the corner from where our house is being built - so we drive past at least twice a day and can confirm that during this whole time there seemed to be only 1 contracter onsite each week to do one job - its like the supervisor couldnt handle organising more than one thing at a time. They have also stuffed up all along the way. We had stain grade window ledges and architraving added to our contract - but when we drove past the house after the windows had been put in and the brickies had just started we noticed that they werent stain grade! It was plain white crap! We phoned them straight away and their idea of fixing it was to jsut put a very thin layer for stain grade timber over the top! We refused and told them they were in breach of contract if they didnt fix it. It got fixed....however the whole building process has been like this - we drive past notice something they have done wrong and then email them to fix it (I say email - because oour site supervisor cannot be contacted by phone unless you set your phone on redial - he usually eventually picks up after the 20th call! lol) Our tiles in the home have all been layed so crooked - its hard to beleive a trained tiler did it - infact we have heard through people we know in the field and it seems that cavalier werent happy with their work either and refused to pay them....however they insist to us that the work is satisfactory! Its also funny how each time they stuff up and have to fix something - we get a request for extension of time saying they cant get tradespeople etc!! We also know that most of the reasons for actually not being able to get tradespeople is becuase they dont pay their bills....We have heard this first hand. We are now having a drama with the patio! Our plans specifically show that the patio is 'built in' ie solid underneath looking up from the first floor and solid floor to stand on. The colour selection also clearly states that the patio finish is trowelled concrete finish. We also had been notified before we signed the contract of another house we could drive past and see which was the same design to see if we liked it. this house has a 'built in' patio and on speaking with the owners - this WAS not a variation of their contract. Cavalier are now trying to back out - and saying that the way they have done the patio is correct as per the contract!!! That the patio floor is included in their WOOD schedule.......who the hell cares whats in their wood schedule - obviously someone stuffed up!! I really dont know what to do from here. We have had a private inspector do the walk through with us where we listed over 100 defects although only 3 major the rest minor - he doesnt think that Cavalier have a bad name and they are ok. We were very concerned to see that the private guy we paidnearly 500 dollars to arrived onsite half an hour early - surprise so did our site supervisor and they were having a nice friendly chat before we got there! Hi, I can give you some advice: a) don't make any more payments!!!!!! this has worked in that I am getting my faults ALL fixed. b) Depending on where you are - get a streetwise solicitor - make sure that you get a solicitor who is an expert on housing and building contracts. I found out that when I told them that I now have a solicitor and I started quoting what the solictor told me - they then sat up and took notice. If you live in QLD then I can recommend my solicitor. I also contacted the BSA and I told them what the BSA told me - if things are not done to contract then you will report the issue to BSA and put a complaint. c) Tell them that if they don't do work according to your expectations then you will get quotes and deduct the money at the end of the contract. Money is the only thing they listen to and I have used this ploy twice. d) Don't accept mediocre work!!!! Insist that it is done properly - find a different inspector. e) Refuse to pay - refuse to pay. Since I have refused to pay - they have threatened me with breach of contract, tried sending me abusive emails, etc, etc But because I stood my ground - they are fixing all the faults. f) We should get together and approach Channel 7 and 9 because the sub-contractors tell me that they do this to everyone. g) They expect you to give up, they will tell you everyone of their other customers are happy - but it is all cow manure. Stand up for your rights because they don't want to go to court. I can help you more as I am further down the path with them - I don't know how to share phone numbers with you privately - perhaps someone can tell me. By the way - since I have got legal advice - Cavalier is trying to finish my house in the next month or so. h) I hear that handover.com are good in checking that all the work has been done to spec and I will be using them. i) a tactic that worked for me was that I wrote a letter to all the franchise owners complaining about the slow build and I also wrote to the owner - Gbemportato@cavalierhomes.com.au, The financial officer is - pgale@cavalierhomes.com.au This will embaress them into action All is not lost if you threaten to terminate the contract on the grounds that they have taken too long to build the house.
