Times like this i'm glad I work as a Risk Manager and did a risk assessment on them and determine they weren't worth the risk. Per my previous post 14months and no contract. I finally got the contract( with many errors still on it) and did my due diligence. Repeated requests to provide examples of completed homes near my area never got addressed. Repeated attempts to request completed homes that was built by the same team that will be building my place never got addressed. Amongst other things the main one was I did not feel i was treated like a customer, hell i was going to fork $500k over to these people and i was treated like i was buying groceries. The care factor was extremely low and thus i ended up donating $3K to them. It took me 6 weeks from walking into my new builder's office and signing the contract. So far so good.... Yep....still very p *ssed off. Went to the house today, and to my absolute horror, it hasn't been worked on at all in over a week. This is a house that is now in liquidated damages, and has been PROMISED to me by next friday, and they haven't been there in a week !!!! I called the supervisors manager today and managed to get an onsite meeting with him tomorrow. Will have to see how I go. Hell hath no fury like a women scorn.... if I don't get the house by next friday (1 August), then by 2 August and every subsequent weekend I will start a campaign outside their display villages offering potential customers my story for them to consider prior to signing on with them. Check your contract because you can dispute the notice and I think you should, you have so many days in which to do so, our contract states 7 days (I guess depending on whether you are accepting whether it is from them or not due to the letterhead). Just to cover yourself because it can get messy, maybe you should advise that you have received it but until such time that it comes in the form of a letterhead that you won't accept it. Although the contract does not state that it has to be so be careful about that. They would have allowed a number of rain days in their contract so it is not acceptable that they want more simply because they can't get the house built in time. They are just trying to find ways to reduce the liquidated damages that they have to pay. I don't even know how a builder is allowed to request extra days after the building period has ended, especially when it's their fault that it has taken so long, it's almost criminal. I have found in my own experience that with a builder you should put absolutely everything in writing. Thats exactly what I have done. As a lawyer, you can guarentee they get it all in writing from me. I have had a further onsite meeting with the area manager to lock in some commitments for completion of the work. They are working there today which is a good sign. They have known all along what I do for a living, but it makes absolutely no difference when the contracts are drawn up SO in favour of builders. I still don't have my house but after my last onsite meeting with them, they have certainly pulled their finger out. I'm hoping for friday or monday, then I will wave them goodbye and get them out of my life once and for all..... Our sales rep is based in pakenham - he's also knowledgable, but his feedback and follow up is not so good. He gave us those target dates and didn't bother to chase the drafting dept until we called and made a fuss about the delays. This lack of feedback and follow up ticked us off more than anything else. The reason we're worried about the delays is because we have already settled the land. Every week's delay cost us an extra $400 in interest. That's on top of our existing mortgage! In Sydney most of our customers are faced with this issue as land always settles before plans are drawn and submitted to council. The extra interest almost always deters first home buyers. My husband is very pedantic about things (ie. little cracks in the slab - surface cracks only - apparently occurs when it is very hot or some rain when they are pouring the slab - which it was) but I've told him to chill out. We aren't the supervisor and our house will be built as per our contract.
I had a window slightly off centre and then I realised it was on the plans i have signed. I did request it to be changed at an early stage but forgot about it. They have changed it to be centered now. Re: JG King Homes 57Jan 24, 2009 8:08 pm MBBN. I assume you work for JG K1ng.
We are building with the metro office and hoping for a start soon.. settlement took place 45 days ago and our contract does state that they will do everything possible to have construction start within 14 days. Our latest update is the constuction file is due any day (10 days ago) and then you will be assigned a site supervisor. Do you know what sort of timeframe we should be looking at for a start now? new home, the archs and skirts are cracking away from the walls because of the steel frame. Her experience was more than horrible and she would NEVER reccomend building with them. I am currently looking to build with JG King I would never build with Fowler homes. I built with them in 2021 and till date maintenance issues are pending.
