Browse Forums General Discussion 1 Feb 11, 2009 8:46 pm Our builder uses the Master Builders QLD Residential Building Contract document. Id much prefer the BSA contract, as they seem to be more supportive of the consumer, but thats just what he uses.
Im chasing a copy of the Master Builders contract so that I can read the items and know what to expect before he asks us to sign. Does anyone have a sample one they can email me? If so, please PM me. And no the MBQ wont give me one without paying $25 bucks for it. Also anything to watch out for in these contracts? Make sure that they cover your rent and storage and double removal costs (if they dont finish on time and you have to move out of rental property.) You can use this to play hardball at the end of the build process, by refusing to move in until you are satisfied that the job is done. Ive seen builders give false move in dates to get you to give notice on your rental property, which makes you real desperate to move in the house in any condition. P Hms did this to us and i must say they are masters at manipulating these contracts and tender contract. Remember with your "tender contract" that if it doesnt say what you want in it, then you wont get it, detail detail detail (we lost $8000 because we trusted what the sales guy said... dont trust them) Re: Master Builder QLD building contract - does anyone have one? 3Feb 12, 2009 11:52 pm A trick with the MBA is the liquidated damages... If you don't put anything in there, it defaults to $15 a day... A pitance for any builder... Make sure you hit them up for at least $100 a day to make sure they need to finish it by the promised date...
And yes the MBA contract is much more orientated to the builders ( their members) where as the BSA contract is better for the buyer.... You can always ask for the BSA contract to be used... Failing that, if you are not used to contracts, get someone ( a solictor) to review the document and put it into plain english for you! Electrical Engineer... Don't hold that against me... And keen owner builder... Mainly the building part!! Re: Master Builder QLD building contract - does anyone have one? 4Feb 13, 2009 3:45 pm i have just had a bad contract experience, and the wash up is that you really need to get legal advice - the liquidated damages clause is one issue, but there are heaps of things that aren't as obvious and can get you in trouble.
to be even more specific, try to see a building contract specialist who really knows the contracts back to front. People proceed with signing the contracts because they are "standard" which they are - but that doesnt mean they are fair! And on that note, does anyone know/recommend any "building specialist" solicitors in the Brisbane area? I think there is also a "cost escalation" clause in these contracts which im not sure about.
