Recently got our contract from the builder. In addition to the normal HIA contract he has added some extra clauses, one of which has me very concerned:
"It is acknowledged by the Home Owner that it is their sole responsibility to peg the four corners of the dwelling before and after site works commence. The Builder takes no responsibility whatsoever for the wrong positioning of the dwelling on the block."
I should add that we are not doing any of the work ourselves, the builder is doing everything. Whilst there probably won't be a problem it concerns me that if there is, we could find ourselves in a very tricky position. Surely management and resolution of problems is part of what you are paying a builder for ?
The builder has said that he puts that clause in all his contracts and will not remove it. Has anyone else encountered a clause like this, and what did you do ?
