Since signing of contracts (Nov '07) and construction beginning (Dec'07) was due to be completed by 8th August '08 we have found out that all of our kitchen appliance choices were superceded in September. From what I have been able to gather from the builder they only ordered appliances last week. The new models will add about $3500 to the price! What I need to know is who should pay this extra cost us or the builder? Remembering of course that if they had finished the house as contracted this would not be a problem. We had several things discontinued - bricks, floor tiles, taps, locks, bathroom fittings. The tiles were changed a year after signing the contract - but there was no additional cost to us. If this is the case, then let the builder know this and that there shoudl be no price increase.

First of all they have to send you a variation in writing setting out the changes, the reason why and the costs before they can do anyting. If they go ahead without this then it's their cost. You need to sign it if you are going to accept it or put in writing if you are going to dispute it. They have had plenty of time to order the items and I agree with Casa, the prices probably haven't changed. It seems to be that they are wanting to charge you the extra that those signing up now would be charged. I would give the BCAV a call just to determine their views on the matter and get their advice.
