I would also ask, at the same time, for - their formal trading name, - the name of the Public Officer of the company, - ACN, - registered office address - builders registration number so that you can ensure that VCAT, Building Commission Victoria and your solicitior all have the correct information if you decide to institute proceedings against them regarding their treatment of you and the return of your deposit. You have to decide whether to follow through. Personally, I have used a lawyer at each step of the building process and will use a licenced inspector for all 5 stages of building too. Hmmm.... I recieved an email on Friday. It seems our file has been "reviewed". The offer is much, much better. I'm quite confused and still not sure, but I think we may take what they are offering. I had told them I was not accepting the original offer. I explained that as we left M because of their incompetence, I didn't think it was right we were being asked to absorb their costs. I also mentioned consumer affairs, VCAT and the media. I then went to someone who I know is "on my side" in the company after I hadn't heard anything.... two days later, a new offer. The current offer does not include any costs of theirs. We are only being charged for "outside" costs. The contour survey and the soil report are ours so... all in all it's not too bad I guess. At this stage though, I think it's enough for me too accept it and walk away. I know I'm doing what I complain about all the time..... just accepting it cos it's easier.... Not sure what to do.
