I checked the sunset clauses and the laws in NSW were amended so that developers would need to get consent from purchasers and a judge has to tick that as well. Pretty much impossible to use the sunset clause to rip-off clients. Also developers cannot have access to deposit funds during development stage. That seems fair to mitigate risk. This developer has delivered 2 other projects without dramas. The reason developers insist on deposits is so they can go to banks to show viability of project and get loans to finance the project. If the project fails the bank and developer will not be able to access the deposit money anyway in NSW. My main issue was value of land, I guess the developers overpriced the land to cover their interest charges for loans they will get to develop the land. Banks don't lend on collateral they can't call.
