When it rains a lot the water seeps through the garage. It has happened over 5 times in the last two months. My builder has applied water proofing and silicon in the edges internally, but the seepage still happens though it is less. The builder wants access to the neighbor's property so that they can work on it externally, however my neighbor is not cooperative and not agreeing - Generally not friendly neighbor. The gap between the fence and my garage is about 8 inches. Want to know, 1. Is my builder responsible for not having made a drainage? If so, how can I hold them responsible? 2. Is my neighbor responsible for inaction in this area that is causing the seepage to continue? 3. What authority will assist me in getting through the builder to do their job and the neighbor to agree to do their share of resposibility. 4. If I get access to the neighbours driveway what should the builder do so that the problem is solved permanently? I do not want the builder just do a paint job or a temporary job. You can try one of the drainage cells that can go in narrow spaces along your garage wall with Geofabric protection and waterproofing your garage wall from outside. The stormwater would need to be drained away and the drainage cells need regular inspection and maintenance. Please see below answers to your questions; 1. Yes, your builder is responsible for not protecting your garage wall and not installing proper drainage. You can complain to the building authority in your state that issues builder licenses, fair trade office or the tribunal/court. 2. It’s expected that each property contains its stormwater onsite or discharge it to a legal point of discharge in a way that doesn’t cause harm to neighbouring properties it’s also some councils requirements. The problem is not only water seepage inside the garage but the damage to the building from movement that this water could cause to your house foundation. If your neighbour land on the high side and it’s expected that stormwater would go to your side, you need to protect your property from that water asap and do what you have to do. 3.
