I bought a unit which came with a car space and was approved for the First Home Owners Grant. A neighbour kept parking there without my permission until I left them a few notes asking them not to. They have now contacted me saying they're willing to pay to be able to park there (I don't have a car). I have read the FHOG Act twice and looked at all the relevant pages of the Office of State Revenue website but can't seem to find anything on whether I am legally allowed to charge someone 'rent' to park in my car space. This means you are allowing them to park there you could be liable for anything that may happen, I personally would ask your solicitor for advice. It wouldn't matter if Coookie was parked there, or if a friend, neighbour etc was parked there. Besides, what damage would come out of using a car park.

By that I mean think about the future. What rights will you have if you want the space temporarily? What happens in the event you do get a car? What happens if you choose not to lease the space anymore? what will they say or do in those sorts of situations? how will you overcome them without argument? Check what you are covered for in the terms of your purchase on the property. What does it say you are responsible for? ie damage to the parking space surface etc. Where will they stand in the event you sell? can they claim the space is theirs to lease because they have leased it for so long? It may seem trivial but in your best intresets to plan for the worst and hope for the best. (the most likely outcome is sunshine and butterflys ) what do bigger carparks do when leasing spaces to companies? I drafted a written agreement (I work at a law firm) to cover the issues mentioned by 'Onebuild' and 'Fu Manchu'; however, my neighbour only wanted to pay $12.50 a week so the agreement isn't going ahead.
