Garage Door Malfunction

Hi Guys. I need some assistance if anyone can help from a builders prospective. Long story short, our garage door malfunctioned due to the Torsion bar bearing plate coming away from the wall. After taking away the plaster, we found the timber packer had split that the 2 fixings/screws were attached to. The house is only 5 year old and the garage door company who temp fixed it said contact the builder as its a structural issue. Told builder who doesn't want a bar of it, will not even have a look and will not help as he's saying it's not structual. So where do we stand?? Can it be fixed under the 6 year structural warranty in Vic? Would it hold up if it went to VCAT? Any thoughts or help would be great! Thankyou...

It looks like an easy fix with a longer screw right into the timber behind the packer.
Yes its builders defect
Yes the builder is liable to fix it under warranty
Yes you can go to VCAT after you have been through DBDRV and it will cost you plenty. or
Just get someone to fix it for you

As you can see it will need new structural replacement to hold the door, replastering, painting, new anchor plate. The Torsion bars are bent, The roller door company who initially had a look to lower the door back for security doesn't know if the door is damaged further. So will be a few dollars I would imagine.
