Well Ive been quetly lurking around this forum for quite some time now and I must say, that its been a great source of information whilst building my new (first) home. I'd like to say that the reason I finally registered was because I finally got sick of being under cover *hehehe* but im affraid its more serious than that. Seeing the great advice you guys have given others, Im hoping that you will be able to help me. To jump straight into it, heres my story. I've been renting my current home for just a little over a year now. A few months into renting my family and I decided to build as we had a new baby and hence needed more space. The home we are building just finished lock up stage and is expected to be finished by late January or early Febuary. The problem is our land lord sold our house and the new owners want to move in late December or early January. Because we knew we would be moving into a new house early 2009, we didnt bother renewing our rental contract when it ended in Selptember and have just been paying rent every month. We have talked to the new owners and aksed if we can stay in the house until the our new house is complete but they want to move in asap. We have no where else to move, and I dont think we can rent another house for just a month. That together with the added stress of moving with a baby and the expense of hiring removalists twice makes me just want stay put until they drag me out. Sorry about the long post guys, but does any one have any advice or is famililar with tenant rights? If worse comes to worse, does anyone know any reliable storage places that can pick up our things, keep them in storage and then deliver them to my new address? don't just do something, sit there. Re: Advice Needed.. 2Nov 01, 2008 3:23 pm Hey Bubblez, That doesn't sound like fun at all, and I hope we don't face the same situation but the new owners do have every right to move into their own house.
There are a couple of things you could consider..... 1.Will you be putting a shed on your property....you could make allowances to get it installed before moving in and storing some stuff in there. 2. Does anyone you know have a shed you could store stuff in or would any family members consider letting you put a shed up in their backyards for the same thing.....then when you move in take the shed with you...... 3.How close to your house being finished would you be, could you store anything in your garage. All these things would have to be spoken to your building company about. With all that in mmind you could....housesit...there are websites you can look on for areas and places.....or short term accomodation.....they are generally fitted out but possibly a spare bedroom could house some of your stuff....... I was in a similar situation. Our lease was to run out in August, and our house was (is) not going to be finished till end of the year. We thought we would be able to just rent month-by-month till the house was finished, but then they decided to sell. We were lucky to be able to move to my parents' place for the intervening months, and had to put all our furniture into storage. But we had a 4-week old baby and a 2yo toddler at the time of the first move, and we still have the move to the new house to go, so I do feel your pain! gweluphome has given some good advice. The only other advice I can offer is, the way we worked it, one partner looked after the move - sorting what to put into storage, packing boxes etc - while the other one looked after kid(s). We have thought about keeping things in the garage, but we're affraid that it might be a lttle risky. Our neighbour behind our house just finished fixing stage a few weeks ago and have had theyre cupboard handles stollen. I have no idea why someone would steal cupboard handles of all things but it did make me think twice about putting things in our garage. So far we've been ringing around getting quotes from various storage places and so far the avarage seems to be around 1K for a month for an area of aprox 6x3 metres. Does that sound reasonable? Anyway some good news today.. We are now officially at lock up We stoped by the house on monday and were suprised to find someone working on it. Well not technically working on it, they were just there with their yellow spray can to mark the mistake with the power point position in one of the minor bedrooms. But guess who was with him.. Our S.S It was the first time that we've actually seen him and he was great. He answered all of our questions and showed us a few minor mistakes that should be fixed in the next few days. He also said that the bill should be comming soon as well He also said that we're still on track to finish late Jan - early Feb even though the builders get a month holiday during dec. don't just do something, sit there. The new owners obviously have given you the required written notice to vacate. You could stay on the extra two months but you will then be liable for the extra expenses the new owners will incur by not being able to move in, the owners can then recover these expenses from you in the residential tribunal. If it was me I would see if I could come to a financial agreement with the owners so I can stay till Feb., if it works out cheaper than moving again or storage costs I would be ahead financially and stress wise. If no agreement I would have to move as I would not like to create the legal headache for myself. If not you could try 'PODS" - Portable On Demand Storage. Not sure of their number but I hear them advertised all the time on the radio....they are like big shipping containers that you can have delivered wherever, store your stuff for how ever long you need to, then they will take it away for you. Our neighbour behind our house just finished fixing stage a few weeks ago and have had theyre cupboard handles stollen Just be aware that anything stored at new house will not be covered by your household insurance or the buliders insurance- I know we had some tiles which we bought ourselves (long story, builders tiles no longer available) and we were told to store at our own place as builders insurance would not cover them if anything happened and they were not the property of the builder (unlike the cupboard handles which at least would be covered by builders insurance.) If you do store anything in garage of new house before handover I think you would be wise to start your house and contents insurance straight away rather than at handover as is usual. Re: Advice Needed.. 8Nov 05, 2008 7:48 am What I would do is give notice to the new owners of your current rental now, find smaller, cheaper accommodation, sign a six month lease, move at the end of November. Once your new home is almost complete pay the re-advertising fee to the real estate (maybe $100) and have the place re-leased. I would pack very well now and only take necessities to the interem home and either store stuff in the garage there or put into storage. Make sure you pick a rental that will be easy to re-lease. Breaking a lease if no big deal, you just need to pay the advertising and wait for someone else to take the property. Not in Vic, if you break the lease you have to pay the rent until someone leases it. No pretty especially if you have 3 months left. I would not consider doing this. I phoned the new owners of the property a few days ago to see if we can work something out that would benefit us both but we couldnt come up with anything. I cant really blame themfor wanting to move in asap because It turns out that they are in the same position as we are. Theirlandlord sold the place where they were renting so instead of finding a new place to rent they just decided to buy a house. Fast forward to today and I can happily say that my family and I have found a place to stay well technically a friend of mine had a few spare bedrooms in their house and offerred them to us for the time being.. being in the situation we were in who were we to turn down an offer like that Also thanks Grace16 for mentioning PODS.
