Browse Forums General Discussion 1 Oct 31, 2008 10:37 am We placed a deposit on Kempas prefinished floor a couple of months back. We told the floor people that the house will be ready at the beginning of October. However, the house was delayed until now. Just received a call from floor company that the price is now $500 more. Does anyone know what our rights are?
Thanks. Re: Increased price of flooring after deposit 2Oct 31, 2008 2:30 pm Gee, that sounds ******* - onceall the paperwork is done, and you've paid a deposit , is that not considered a (legally binding) contract???? Hopefully someone will know exactly what your rights are - I'm just guessing! Good luck! Is there lots of fine print written anywhere on your contract. Also I would think they would have had to have your order ordered well before now so in the last 3 weeks your floor would not have cost them anymore. Tell them its a disgusting way to treat good paying customers and they can pass on their price increases to new customers but your not wearing it. They could have at least given a notice to inform you that if the floor is not layed within a certian time period you will be charged. Otherwise tell them to suck that cost up somewhere else.
Sorry I just got mad for you. Re: Increased price of flooring after deposit 4Oct 31, 2008 3:01 pm Check the fine print...we just purchased some carpet from Carpet Choice and in the fine print it states something about reserving the right to charge for storage after x weeks...was a standard clause on the back of the invoice...of course it could be negotiated away at time of order if you pick it up.
Wasn't a problem for us as we wanted it ASAP. mmm....donuts Homer Simpson 1956- Links: Site Costs Ready Reckoner | H1 Addiction Medical Advice | Château TDL: The Backyard Re: Increased price of flooring after deposit 5Oct 31, 2008 3:18 pm That's what we think. What happened was that the the floor company ordered the kempas and called me to say that it is waiting for me, just let them know when we need it. It was their supplier who sold it to someone else! Now, the supplier has to order more from overseas, and because the aussie dollar is less, it will cost us an extra $500. Our argument was that it wasn't our fault that the supplier sold it to someone else, so why should we, the customer, have to pay for the increased cost?
TDL the only receipt we have is a hand written little docket with the total amount, less deposit, total amount due for supply and install prefinished Kempas and a date of deposit. Nothing else. I will try Fair trading and see what they have to say. When we first approached them, we told them we are not positively sure how long the house would take. Since it only take one week to get stock in, we told them we will return when the house is near completion. However, they said 'to secure the price we have to leave a deposit , so we did. I am not sure if this is a gimmick to get more money out of us.
