Browse Forums General Discussion 1 Mar 29, 2023 11:44 pm My husband and I are building our first house, and went out to our block over the weekend to see what work needed to be done to clear the block of weeds ahead of the slab being laid. As soon as we arrived, the problem was immediately apparent. The blocks in the street are supposed to be running parallel to one another. Our neighbour to the right has their slab laid and the wood frame is already up, but the whole house has encroached into our block by 5m, cutting our block in half diagonally. This means we won't be able to build at all. The neighbour is using a different builder to us. We alerted our builder straight away, and they got our site manager out first thing to resurvey the property, and they are indeed encroaching well into our block. Do we also need to call the council and request a stop work order to prevent the other builder continuing? And what other steps do we need to take to get this fixed? It's odd that the surveyor setting out your neighbours house would get it so wrong. Usually a builder won't start setting out unless the property's boundary pegs are present or been fully re-established. Such an error should never occur realistically. Let us know how you get on. Be prepared for the worst, it will take months and months to resolve this problem and start building. but.....provided the builder at fault doesn't go bust rectifying, all costs, interest and increases in labor/material costs that the Op is likley to experience during the period are a loss they can claim against the other builder. Our builder sent out our surveyor yesterday, and are checking the boundary lines, but at first glance, the other builder actually either knocked out, or removed one of the posts. We will be calling the other builder today to inform them, once we have the exact measurements, but by the original council plan, we're supposed to have 15m across our backyard. Instead they've left us with roughly 6. i did click it, still couldnt make it out rofl. in any case, doesnt look like too extreme a slope, you may be in luck.
