The contract practical completion date lasped on 2nd Nov 2022, we are now in the realm of damages as per the Qld Master Builders contract. The builder has been communicating a handover date of 21 Feb 2023. Today the builder has sent through an extension of time request for 10 days due to supplier issue, the new date for practical completion is 3 March 2023 (10 days post 21 Feb). My question is- because the extension of time says "new date for practical completion after allowance for this delay" as 3 March does that mean damages claimable from 2nd November to 21 February would be forfeited? I feel like the extension of time date should be 10 days from 2nd November (i.e 12 Nov). And from the 12 November 2022 we would be eligible for damages. Does anyone have any experience in this to share.
