Thanks for taking time to read this. I need help to ensure my argument is right.
With reference to the attached estate plan image, I own the corner vacant lot numbered 16321. My neighbor owns 16322 just behind me at the coconut street. My rear fencing was already laid by the developer. His plans are approved by the developer based on which his garage wall would be right at my rear boundary. This is totally fine between adjacent lots. In my case, his garage wall will replace a middle portion of my rear fence and so I’m being asked by the developer to provide my consent to take down a portion of my rear fencing.
In other words, standing at my backyard, I would see a rear left fence then a garage wall then a rear right fence. The other option is to bring the middle portion of fence (against garage wall) slightly inwards to have a continuous fencing.
Based on my research, there is no such precedence in our estate (pics attached). I have a feeling that the developer had approved the plan oversight as he did not provide any rationale about this inconsistency. The estate guidelines doesn’t clearly specify on the setbacks required in relation to the garage walls behind a corner lot.
Please do let me know whether this is common in other parts of Australia. I also appreciate any links or materials to support my argument if right ?
