Browse Forums General Discussion 1 May 20, 2022 12:24 pm Hi there I'm in NSW and a new house is being built next door to me (almost completed). As it was approved via CDC we were not given any opportunity to view the plans. We now have 3 bedroom windows and a bathroom window looking into our rear and side yard. **Just a note around our side yard.....we have an odd shaped block so our rear yard is really just a courtyard alfresco and BBQ area, and our side yard is a large space with a grassed area, gardens and a spa. One of these windows in particular has full view of every space in both back and side yard (even all the way across to our other neighbour's yard) and we now feel very exposed... we can almost feel it following us as we move around in our own yard if that makes sense haha. I came across a document thru NSW Planning and Environment called "Privacy requirements for residential complying developments". Its from 2015 and can't locate if there are any amendments to this. It goes into detail around having to screen certain windows if it is within three metres of the boundary and higher than one metre from ground level. The one window in particular that is of concern is right on the 3 metre line (2.95 m according to our measurements) When I speak to council, they tell me to talk to the certifier. I'm waiting on the certifier to contact me, however looking for anyone who may have dealt with this before and has some tips. I want to be prepared if they try to brush me off or argue the actual measurement. The private certifier probably won't even bother responding to you. See attached.
