I have attached site plan. There is 200mm from the garage wall to boundary. 1400mm from left side of house to boundary. 1230mm from right side of house to boundary. A habitable room window of a building on an allotment must face an outdoor space or light court with a minimum area of 3 m 2 and a minimum dimension of 1 m clear to the sky, not including land on an adjoining allotment; So according to this I can't have 450mm Eaves as they will come within 950mm (closer than 1m) and not allow 1m clear to the sky. I'm guessing there is also 150mm gutters that will encroach within 800mm of the boundary. My plan then would be to go 300mm Eaves, but again with gutters this leaves 950mm clear to the sky. POTENTIAL SOLUTION: A new building not on or within 200 mm of a boundary should be set back from side or rear boundaries 1 metre. I will need this side to be setback 1150mm as this allows 150mm for the gutters and still leaves 150mm clear to the sky. As it is currently 1230mm, could I shift the house to the right 80mm. This gives me 1480mm on the left, and accounting for 150mm gutters, still leaves 330mm for Eaves? The issue now is, according to the regulation above, the garage is now 280mm from the boundary.
