Now we have got a land contract and we signed that too with developers. When it comes to building contract we came to know that builder has extremely few inclusions in their "fix priced deal". This means I have to pay atleast 60k more after the house will be ready. Now in this circumstances, I dont want to go ahead with this builder... can I pull out of the building with that builder while keeping intact my land contract , as I did not signed anything with builder except 1K advance ?? Will it impact on my land contract which I have signed already?? I check land contract does not say anywhere that I have to choose this builder... I am happy to loose my 1K now instead paying 60K latter. Please help ad I have no specialities this area... Re: Help need .. can i pullout home and land package 2Jan 23, 2022 9:45 am you need proper legal advice it may not just be the $1k, builder may claim for the lost revenue on the whole job on the other hand builder may want to get out of contract due to price hikes and demand at the moment how long from when you signed until you changed your mind depends on exact wording and dates Re: Help need .. can i pullout home and land package 5Jan 23, 2022 2:10 pm Hey zeeextra Has the cooling off period for the contract finished? You may be liable for damages but in most cases if you just have an in person meeting with the builder and tell them that you cannot get the bank approval for the project they will just release you from the contract. The contract you signed will most likely be subject to financing in any case. They would need to spend a few thousand chasing you for the money and risk bas reviews online (builders HATE bad reviews). Just sit down with them and say it's not possible for you to go ahead. If you have not signed a building contract then you are within your rights and you may be able to claim $1000. It is not quite accurate that "No contract is effecting unless such time as both parties have signed off on it.". There are very few instances where a written contract is necessary to be binding (land purchases is one). In most cases, so long as there is "offer" and "acceptance", as well as sufficient certainty of the terms, you can have a contract. Paying a deposit usually indicates acceptance of something - the key is what exactly was accepted. Read what is in writing carefully (including emails relating the the $1k deposit), and if it is not clear, consider legal advice. If he hasn't done any just request a refund BUT BEFORE ASKING FOR A REFUND. The land, Look in the conditions of the land contract, is there anything the states the land contract is subject to and conditional upon you entering into an unconditional building contract with XYZ Builders? if not:- If the land is under put & call to the builder, you wont get the land. If the developer is the builder or a related entity to each other then, you wont get the land. I would suggest go and look at what other builders are building in the estate, if there are only a couple, you probably wont get the block. If there are a lot of other builder, go and talk to the land sales consultant, and ask what other packages are available on other lots "my family is looking for a house and land package around here as well" if he only offers packages with the same builder, you wont get the block, however if he gives you a range of packages with others, your in with a chance. Don't sign the build contract and proceed with the finance for the purchase of the land. We are Expert Consultant's, and we are here to help.
