Browse Forums General Discussion 1 Jan 22, 2022 4:24 pm Hi, When comparing what you can build under a complying development certificate vs DA with the Northern Beaches Council NSW Can someone please assist what the rules are when it comes to the rules which apply as we are on a bend and the neighboring houses currently sit further back than ours. If we extend our living room or bedroom at the front of our property, is the setback for the new portion able to be equivalent as the existing part of our house. The properties up and down the street are mostly set back further than us except for one or two well up the street which are nearer the boundary. Other houses across the road have garages which are only 4 to 5 mts from the street as their land drops down significantly so it's not possible to do build one otherwise. I have attached an image (CDC setback vs DA) which represents our house on the property and the "grey area" is where we are considering building the extension. FRONT SETBACK 1. How close to the standard suburbs setback (shown in red) can we build if the setback of on of our neighbors is 3 metres and we are currently 2 metres in the part of the house we want to retain and the other neighbor is 4 metres back under a CDC vs DA. 2. How close to the current suburbs setback (shown in red) can we build if we do a knock-down rebuild? 3. Is there a difference for the setback at the front as we work the curve at the front of the house? Does that line follow the same arc as the curve or is it a straight line as shown in the image. Send an email with all the information and do a follow-up call few days latter and ask to speak to DA department . Re: Complying Development Setback - Northern Beaches Council 3Feb 01, 2022 8:41 am The standard setback for most of the NBC is 6.5m. Just because your neighbouring houses are further back ( as is yours currently ) doesn't mean you have to be in line with theirs ( under DA rules anyway ). Going through CDC however you would have to be approximate to theirs. Going through council for a DA , you would have a pretty strong argument. The disappointing part is we are trying to prevent building out into the backyard (preserve greenspace) by building over the existing driveway and the only way to achieve this is with a Development Application. Typing out loud: There should be more fine print added to CDC rules which control when and why you can and can't push forward beyond the neighboring properties average. Something like; you can extend forward up to your existing setback up to 80% of the front of your home at ground floor, no closer than 1500mm to the side boundaries. Add an extra 500mm setback at level 1. This would cover my needs and we certainly won't be impacting the neighbors under CDC (even with my dream rule added) however if we go with a DA the allowance far greater under the State Planning rules.
