I realised that all other states, like NSW and VIC have their own "building contracts act" or "home building act" which provide detailed legislation around the common contractual clauses, eg. maximum excess payable for owner for provisional sum items. However, in the case of the ACT, we rely solely on the generic national building code -- and generally the code talks about building standards but fails to consider the contract itself. So why does a building contracts act not exist for the ACT? Is the government implicitly favouring builders?
