Need some urgent help. As you might be aware, we are having trouble with D?mir Leather about them refusing to refund our depost. I posted a topic on this the other day, currently temporarily taken off-line while we lodging claim with Consumer, Trader and Tenancy Tribunal. Just wonder if there's any one living not far from Auburn, Sydney can kindly provide some help. In the letter we received from Fair Trading, it says "Sandra the Manager of D?mir Leather" advised that we were provided all detail information about the lounge (which is not true!). We don't even know who this Sandra is, as she was never involved, thinking she might just be one of the sales, bull **** to Fair Trading commissioner's phone call. To make our case stronger, we like to check her title, and would be best to get a copy of her business card. If it's something like "sales", that would certainly help, as it's another proof that these people have no regard for truth and keep telling ******. We certainly can't do it ourselves, therefore would be really appreciated if anyone can kindly help to: 1) paid a "short" visit their shop 2) ask for Sandra, say something like been referred by friend due to her good ( ) service 3) ask for some suggestions about lounge for living room or something (hopefully won't waste too much of you time...) 4) most importantly, ask for her business card 5) send me a copy by email Or if you can think of other better method, please let me know. Yes and No, I am not saying she is "not" real as my wife spoke to her twice on the phone (and she was very rude...). It's just that she "claimed" to be the Store Manager (according to the Fair Trading letter) and provided lots of incorrect information to them. We were just thinking of providing a proof (her business card) that she is actually just a sales, not a "store manager". Which is the "style" of their company - say whatever they like, all sort of ****** to manipulate the situation for their advantage.... Re: Anyone living not too far from Auburn, Sydney? Regardless - she is acting as a representative of the company - whatever she says is the position of the company. It's like if the Prime Minister or a cabinet minister issues a new policy or directive - it's still coming from our elected govt - no matter who the mouthpiece is. I think if you dwell on this point at the tribunal - it won't help. Stick with the facts of what you were told, what was delivered. I know that it's personally very important to you - but the people that run the tribunal pay very little attention to issues like salespeople being rude. They're more interested in if there were any mis-representations. If you get worked up - the company will use it against you! After 4 years - we're in! That's one of the problem -> unless you have proof, it's very hard for 3rd party to decide who is telling the truth.
We are aiming for the best scenario - getting both refunded, but also prepared to accept the worst - only one refunded. If we are not getting any refund at all (which is even worse than worst... ), we will have to take further action . It should be quite unlikely as they already promised (and I got it on tape), but later overturned by this Sandra lady when replied to Fair Trading & we got it in writing too. So if they are so serious in dealing with customers, they won't be changing/telling ****** left, right and center every time. They are just trying to bull **** through every situation, betting you have no proof that they did say so, and hopefully things will work out in their favour. Luckily I got their rude behavior on tape, which covers a few things that can be used against what they said. I am just hoping to get a few more proof. I'm not too sure if you will be able to use that - it might make things worse, particularly as the subjects did not know they were being taped and quite often stores do have signs saying no photography or video allowed. Mainly because they are concerned about designs being copied or prices undercut, not so much staff behaviour. Be careful with that. Yes, we did mention about this when we lodge complaint to Fair Trading. Actually I never thought of taping until they started acting in a very hostile manner, yelling and shouting when we complaint about the height of the couch back support is very low, and we felt offended and threaten. They did mention to us not to take photos due to copyright, but my purpose is not copy anything, just to record the whole conversation as a proof. We will also provide a copy of the video as part of the evidence when we lodge to tribunal. Which means they will also receive a copy before the process started.
