Section 88k

I have a block of land; Tasmania
No stormwater
On s337 it says there is stormwater available within 30m
Have permission from water utilities to share their easement to put stormwater in
This easement is on neighbour land
He refuses me access
This is the lowest point and on s337
He says take it to kerb
Kerb is uphill 40m
Someone said section 88k
Via supreme Court
The land owner is also the developer who omitted stormwater.
Please tell me what i can do.

I cannot express legal advice but it seems that if there is a drainage easement then you should have right to access it for drainage. It seems that you will have to make application to the court to get the access.
